Knobbe Martens Wins Trademark and Trade Dress Verdict for Longstanding Client Monster Energy

Knobbe Martens is pleased to announce that a Los Angeles jury has returned a verdict in favor of the firm’s longstanding client Monster Energy Company.

The jury found that Integrated Supply Network, LLC infringed Monster Energy’s federally registered trademarks that include the word “Monster.” The jury also found that the company infringed Monster Energy’s well-known green and black trade dress and that it acted with malice, oppression or fraud. For that conduct, the jury awarded Monster Energy $5 million in punitive damages.

“We are pleased that the jury recognized that Monster’s strong IP rights transcend energy drinks and are enforceable against a broad spectrum of goods, including automotive-related products,” said Lynda Zadra-Symes, a partner in Knobbe’s Irvine office.

Greg Gabriel, Senior Legal Counsel at Monster Energy, said, “We could not have been happier with the dedication, preparation and knowledge of the Knobbe trial team. It was a true joy to have the opportunity to work with them and watch them skillfully present the case to the jury.”

Zadra-Symes, who has helped Monster Energy develop and enforce its trademark and trade dress portfolio for more than a decade, tried the case with Knobbe partners Joseph Re, Brian Horne, of the firm’s Los Angeles office, Marko Zoretic, and Jason Champion.

The case is Monster Energy Company v. Integrated Supply Network, LLC, Case No. 5:17-CV-00548-CBM-RAO.
