Attorneys Fees Granted To Magnetar Technologies In Patent Suit Against Intamin, Ltd.

Magnetar Technologies Corp. announced today that Judge Gary Allen Feess of the United States District Court for the Central District of California has ordered Intamin, Ltd. to pay Magnetar $779,100 in attorneys’ fees and $40,545 in other expenses for a total award of $819,645.

This recent ruling follows a May 2009 order from Judge Feess that granted Magnetar’s motion for summary judgment of patent non-infringement, invalidity and unclean hands in the long-standing patent case between Magnetar and Intamin in U.S. District Court, Central District of California (Docket No. CV 04-0511 GAF (JWJx)). The case is a patent dispute relating to magnetic brakes used on roller coasters.

“The Court’s earlier ruling demonstrated that Intamin’s case wholly lacked merit and that Intamin engaged in misconduct in falsifying ownership documents relating to the asserted patent,” said John B. Sganga of Knobbe Martens Olson & Bear, LLP, litigation counsel for Magnetar. “Faced with such exceptional circumstances, the attorney fees award was both reasonable and warranted. We are very pleased by this result.”
