TTAB、商品の出所を偽って表示する商標の登録を取り消す ALEVEブランドのナプロキセンナトリウム鎮痛剤を米国で製造するBayer社は、メキシコで同じ商品をFLANAXという商標の下で販売している。Bayer社は米国でもFLANAXという商標を使うものの、米国での商標登録出願または商標登録は行なっていない。Bayer社がメキシコでFLANAXを販売し始めてから数年後、Belmora社は米国でFLANAX商品の販売を開始し、2005年に米国でFLANAXの商標登録を取得した。Bayer社は複数の理由に基づき、Belmora LLCによるFLANAXの米国商標登録の取り消しを求めてTTAB（商標審判部）に異議を申し立てた。その結果、Belmora社が商標法第14条(3)に違反して商品の出所について虚偽表示をしたことを理由に取り消しが認められた。 これに対してBelmora社は、Bayer社がFLANAXという商標を米国で使用していないため当事者適格を欠くとして争った。TTABは、Bayer社が自社のメキシコでのFLANAXの商標を保護する利益を持つことを説明することにより当事者適格のあることを証明したこと、またBelmora社が自社の商品がBayer社に関わりがあると示唆する形で商標を使っている場合、Bayer社はその評判を管理する能力を失い、損害を被ると判断した。 出所の虚偽表示を明らかにするため、Bayer社は「被申立人が申立人の善意と評判を利用して商標をあからさまに不正使用したこと」を立証しなければならなかった。TTABはその証拠がBelmora社の出所の虚偽表示を「容易に立証する」と判断した。 TTABは、Bayer社のFLANAXがメキシコで最もよく売れている鎮痛剤であり、Belmora社は自社が米国でその商標を採用したときにBayer社がメキシコでFLANAXという名称を使用していることに気づいていたとする十分な証拠を認定した。TTABはまた、Belmora社の所有者が宣誓証言を行なう前に証拠を捏造し、その証拠と商標の採用について虚偽の証言をしたと判断した。 さらにTTABは、Belmora社がBayer社のFLANAXロゴを下にあるようなパッケージングで模倣してメキシコで使用したことも認定した。     最後にTTABは、FLANAXを売り出す際にBelmora社は、次のテレマーケティング文句のような表現を使って[Bayer社の]FLANAXという商標への評判を喚起させた。「私はBelmora LLCの者です。当社はアメリカでFLANAXを製造しています。FLANAXはメキシコ、中央アメリカ[原文のまま]そして南アメリカでの売上が高いことから、ラテンアメリカ市場でとてもよく知られた商品です。」 Bayer Consumer Care AG v.
