Partner Mauricio Uribe and Knobbe Martens summer associate Melis Tirhi co-authored the article, “Good Faith Doctrine and NFTs – How a Bored Ape NFT Dilemma May Present Unique Copyright and Contract Issues,” which was published in IPWatchdog.
The article addresses copyright and contract issues around the alleged theft of actor Seth Green’s “bored ape” non-fungible token. As the authors point out in the article, the situation raised awareness to copyright issues that are yet to be fully resolved: “Seth Green may rest easy knowing he is again the rightful owner of his Bored Ape NFT, but the legal community should not be as quick to move on.”
Uribe and Tirhi also discuss whether the good faith purchaser doctrine applies to NFTs and if so, whether the unique aspects of NFTs and the information embodied in NFTs create unique issues under contract or copyright law.
