PTAB agrees entirely with Global Shade in IPR proceeding against With-U
A team from Knobbe Martens secured another victory for Global Shade Corp. in its ongoing litigation against With-U E-Commerce (Shanghai) Co., Ltd. The team successfully persuaded the USPTO’s Patent Trial and Appeal Board (PTAB) to hold all challenged claims of U.S. Patent No. 10,669,738 unpatentable in an inter partes review (IPR) proceeding and to deny With-U’s motion to amend the claims. The PTAB’s Final Written Decision issued on August 7, 2024 adopted Global Shade’s arguments and canceled all challenged claims.
This decision follows Knobbe Martens’ 2022 IPR win for Global Shade, in which the PTAB invalidated all asserted claims of With-U’s U.S. Patent No. 10,273,710. In 2023, the team also secured dismissal of With-U’s district court complaint asserting the ‘710 patent against Global Shade’s popular collapsible canopy products when Global Shade successfully opposed With-U’s attempt to amend its infringement contentions.
