In a recent IAM article, litigation partner Adam Powell commented on the Federal Circuit’s decision in Finesse Wireless LLC v. AT&T Mobility LLC. The ruling addresses the significant role of expert witness testimony in patent litigation, particularly when technical experts present contradictory statements.
Mr. Powell maintained that the decision is evidence of a “growing trend” of the Federal Circuit reversing or vacating decisions based on contradictory testimony. He further explained that the ruling “serves as an important reminder for both patent holders and accused infringers” to ensure that their expert witnesses steer clear of any contradictory testimony and articulate their opinions clearly.
