Partner Michael Friedland authored the article, "Questions to Ask to Avoid Exclusion of Trademark Surveys," which was published in IP Watchdog.

The article discusses things counsel should consider when working with an expert in trademark cases and using the expert’s draft report or survey questions. Friedland explains that counsel can and should maximize the probability that an expert’s testimony will be consistent with current law and that any report used will accurately describe the survey performed. Friedland also touches on the Federal Evidence Rules that can be used to exclude surveys and ways to avoid these challenges.
