Partner Mauricio Uribe authored the article, "Monkey business: Seth Green’s bored ape NFT and a barrel of IP issues," which was published in World Intellectual Property Review.

The article addresses the IP issues that have arisen around the alleged theft of actor Seth Green’s “bored ape” non-fungible token, and how the theft has highlighted some unsettled IP issues. As Uribe points out in the article, embodying copyrightable works as NFTs present unique risks. And while Uribe argues that it would be difficult to conclude that the doctrine of a good faith purchaser of a copyrighted work would result in the purchaser acquiring the full set of copyright rights to the character depicted in the digital image simply because it was embodied in an NFT, he also notes that the issue does raise some interesting IP issues that may not be as well settled.
