Knobbe Martens Guides Masimo to Successful Resolution of Intellectual Property Dispute
A team from the firm recently secured a permanent injunction on behalf of Masimo Corporation.
IRVINE, Calif., June 4, 2024 – A team from Knobbe Martens represented Masimo Corporation (NASDAQ: MASI) in litigation resulting in a permanent injunction against Sotera Wireless and Foxconn concerning U.S. Patent no. 10,255,994, which pertains to products that monitor vital signs.
In 2013, Masimo sued Sotera Wireless and some of its employees for misappropriation of trade secrets. The misappropriation stems from copying thousands of confidential Masimo documents, and using Masimo’s trade secrets to benefit Sotera. In that case, in 2017 the Court found clear and convincing evidence that willful and malicious misappropriation exists, and that the actions of the employees were “despicable conduct.” The Court then permanently enjoined Sotera from retaining, disclosing, disseminating or using confidential Masimo documents.
Last month, in a separate case in federal court against Sotera Wireless Inc. and Hon Hai Precision Industry Co. Ltd. (Foxconn), the parties settled a patent dispute concerning the creation and sale of products monitoring vital signs. Sotera and Hon Hai agreed to a permanent injunction to stop making and selling ViSi Mobile devices, ViSi Mobile Monitoring System, Legacy Analytics System, or Data Solutions Portal products that utilize methods to simulate alarm delay settings for any purpose such as analyzing delay trends and troubleshooting alarm limits.

The Sotera cases are only the latest in a string of victories where Knobbe Martens helped protect Masimo's groundbreaking inventions.
