Earlier this year, a federal jury in Delaware found that Westinghouse Air Brake d/b/a Wabtec infringed eight patents owned by Siemens Mobility, including finding willful infringement as to two of the patents. The asserted patents all relate to positive train control technology, which has been mandated by the Federal Railroad Administration. After evaluating post-trial motions, the Court recently entered final judgment and ordered Westinghouse to pay Siemens over $14 million in damages and more than $1 million for prejudgment interest. But this does not appear to be the end of the line for Siemens or Westinghouse. In a separate and still pending lawsuit, Westinghouse asserted its own claims against Siemens for patent infringement on positive train control technology.
