Partner Mark Kachner shared insights with Intellectual Asset Management (IAM) and World Intellectual Property Review (WIPR) on lessons patent practitioners can learn from the latest developments in the VLSI v. Intel case.
In the case, a jury found that Fortress Investment Group controls both Finjan and VLSI Technology, the latter of which is embroiled in multiple patent disputes with Intel. The finding could have far-reaching implications beyond the immediate verdict.
Speaking with IAM on the topic, Mr. Kachner maintained that the verdict offers key takeaways related to licensing and due diligence. In particular, he encouraged parties drafting intellectual property licenses to avoid unintentionally including unidentified IP or broadening the license to protect future business partners’ patents. In terms of due diligence, he emphasized the importance of carefully reviewing acquired licenses to understand the impact on the acquirer’s patents.
