Responding to the metric that re-examinations comprised only about a quarter of 2023 USPTO patent challenges, Swaroop, who chairs the firm’s litigation committee, commented on the potential difficulties of re-exams for challengers compared to other types of challenges, such as inter partes reviews (IPRs).
