In the latest installment of Knobbe’s monthly series published in Law360 on noteworthy Federal Circuit opinions from the previous month, Partners Ben Katzenellenbogen and Paul Stewart write about a recent decision in Minerva Surgical Inc. v. Hologic Inc. In that case, the U.S. Court of Appeals for the Federal Circuit addresses the scope of estoppel that attaches to assignment of a patent application. Katzenellenbogen and Stewart write that this raises a number of questions regarding best practices for negotiating assignment agreements and wording employment agreements.
