最高裁が新たな不確定性判断基準を確立 連邦最高裁は、NAUTILUS, INC. v. BIOSIG INSTRUMENTS, INC. (Appeal No. 13-169) において、Federal Circuitの確定性判断基準が緩やかすぎることを理由に、一審の略式判決を破棄したFederal Circuitの判決を取り消し、事件を差し戻した。 Biosig社は、Nautilus社のエクササイズマシンが同社の特許を侵害したと主張し、特許侵害訴訟を提起していた。Biosig社の特許は「互いに間隔をあけて (中略) 設置されている」「活性」電極と「共通」電極を含む心拍数モニターをクレームしている。地裁は、「互いに間隔をあけて」というクレーム文言が特許法112条第2段落の確定性要件を満たしていないことに基づき、略式判決を求めたNautilus社の申立てを認めた。Federal Circuitは、特許クレームは「解釈しやすい」ものであり「解釈不能に曖昧」でない限り確定性の基準を満たすと認定し、地裁判決を覆して事件を差し戻した。  最高裁は、Federal Circuitの基準は特許法の確定性要件を満たしておらず、裁判所が信頼できる指針が不在のままになるおそれがあると判断した。最高裁は、特許は、そのクレームが明細書および出願経過を踏まえて読んでも発明の範囲について合理的な確証がもてる情報を当業者に提供しない場合には、不確定性により無効である、と判断した。最高裁は、この基準は、言語の本質的限界を考慮に入れるだけでなく、特許はクレームの対象を明確に伝えられるよう十分明確に書かれていなければならないことを要求してもいると強調した。よって前判決を取り消し、適切な基準に基づいて再検討させるために事件をFederal Circuitに差し戻した。     最高裁、誘発侵害が成立するには直接侵害がなければならないと裁定 最高裁は、LIMELIGHT NETWORKS, INC. v.
