Knobbe Martens Partners Secure Patent Win For Kamstrup A/S

Knobbe Martens is pleased to announce that attorneys Tom Arno, Kerry Taylor, Ph.D., Jonathan Bachand, and Peter Law prevailed for client Kamstrup A/S in an inter partes review petition to find all claims of US Patent 8,853,559 owned by Apator Miitors APS unpatentable.

The Patent Trial and Appeal Board (PTAB), in a final written decision issued December 20, 2016, found that the claims to Miitors’ technology related to ultrasonic fluid flow meters were unpatentable – in part because Kamstrup’s own prior but unpublished patent application included much of the same technology and features.

“The significance of Kamstrup’s prior patent application to the Board’s decision serves as an important reminder of some of the often overlooked benefits of filing patent applications, and filing them early.  Without that prior Kamstrup patent filing, the outcome may have been different,” commented partner Tom Arno.
