In the IAM article “Federal Circuit Reverse Prosecution Laches in Google v Sonos but Leaves Room for Uncertainty,” litigation partner Adam Powell offered insights into how the ruling could affect future patent disputes.
The Federal Circuit’s August decision in Google v. Sonos reversed a district court’s finding that certain patents were unenforceable under the prosecution laches doctrine. Patent owners should “breathe a sigh of relief that common continuation practice may not result in laches,” Powell said, but pointed out that the decision left open the possibility of prosecution laches applying in other cases.
