On August 31, 2017, a jury in the Northern District of Texas returned a verdict of patent infringement in favor iLife and against Nintendo. The case went to trial after the Federal Circuit on July 26, 2017 rejected Nintendo’s emergency petition to transfer the case from Texas in view of the Supreme Court’s recent ruling in TC Heartland where the Court significantly limited the venues available for patent lawsuits. The jury returned a verdict finding the accused Nintendo Wii™ products when used with certain Wii™ and Mario Kart™ video games infringed the single asserted claim of the patent at issue. The jury awarded reasonable royalty damages in the form of a lump sum payment in the amount of just over $10 million.
