Partner Daniel Hughes and associate Matthew Ruth authored “Open-Source License Enforcement; Risk to Companies” for The Daily Journal.
In the article, Hughes and Ruth discuss how open-source software, which is offered for free, can carry hidden costs and how open-source licenses can carry provisions that are risky to a company.
“Hundreds of different open-source licenses are in use today, each with differing requirements and obligations,” Hughes and Ruth write. However, many of the licenses are so-called “copyleft” licenses, which may require companies that integrate open-source software into their own code to release their proprietary software to the public.
Hughes and Ruth then go on to analyze three developments that show that the barriers to enforce these licenses may be lifting.
