Excerpt: The patents disputes arena has been particularly disruptive over the past 12 months, with several key trends and developments emerging. Among them is the continued impact of the America Invents Act (AIA), the awarding of lower damages, an increase in the use of third-party patent challenges and progress toward introduction of the Unified Patent Court in the EU – an initiative which, alongside a perceived weakening of the US patent system due to the inter partes review (IPR), is expected to result in a major international patent dispute resolution forum.
