Excerpt: “In 2012, the applicant filed an application for the PRO ERA mark (Serial No. 85/711,680) for various goods and services in Classes 25 and 41, including caps. The opposer challenged registration of the PRO ERA mark only as to Class 25, on the ground of a likelihood of confusion with its NEW ERA marks. The opposer alleged that it owned a family of ERA-formative marks covering caps.”
