Foreman, examine trademark and brand protection litigation in the food and beverage industry through the lens of a recent dispute between grocery chain Trader Joe’s and food manufacturer Smucker’s.
The authors discuss the issues at play in a lawsuit filed by Smucker’s, manufacturer of Uncrustables, against Trader Joe’s earlier this year, alleging trademark infringement and other claims related to the marketing and sale of Trader Joe’s frozen, crustless peanut butter and jelly sandwiches. “The dispute highlights that in industries where product differentiation is subtle, branding choices often carry the greatest risk,” they write.
Beyond the Trader Joe’s and Smucker’s dispute, the authors offer several key takeaways for brand owners in the food and beverage industry. They emphasize the importance of strong branding in a saturated market, writing that visual presentation elements such as packaging and logos “form a cohesive story about source and quality” for a product. Further, they conclude, “In a marketplace where products often look and taste alike, branding is not just decoration, it is the differentiator.”
