Knobbe/Martens: Intellectual Property Law

Alloys Cleaning, Inc.

Knobbe Martens’ client Alloys Cleaning, Inc., prevailed in a highly contested patent interference.  Alloys and Knobbe Martens successfully challenged a competing patent that was improperly interfering with Alloys' patent application on novel chemical scrubbing technology.  The Knobbe Martens team argued to a three-judge panel of the Patent Trial and Appeal Board that the interfering patent should be canceled because the alleged inventor had abandoned the application during prosecution and had improperly revived it.  Knobbe Martens supported its argument with detailed documentary evidence and cross-examination testimony from the alleged inventor of the interfering patent and his patent attorney.  In a unanimous decision, the panel agreed with Knobbe Martens and cancelled the interfering patent.
