Knobbe Martens Victory Ranked #5 Nationally in The National Law Journal’s “Top 100 Verdicts of 2014”

| Joseph R. ReBrian Horne

Knobbe Martens Olson & Bear LLP, one of the nation’s leading intellectual property law firms, announced today that its jury verdict on behalf of client Masimo Corp. in Masimo Corp. v. Philips Electronics North America Corp. and Philips Medizin Systeme Boblingen GmbH, has been recognized by The National Law Journal among the five largest verdicts in the United States. Knobbe Martens’ inclusion in the publication’s annual “Top Verdicts of the Year” list marks the second year in a row the firm has been lauded for achieving a top jury award. According to Law360, the Masimo verdict award was by far the largest intellectual property verdict of 2014 in the United States.

The National Law Journal report ranked the top 100 verdicts of 2014 based on the amount of the jury verdict award as determined by its affiliate VerdictSearch, as well as through consultations with practitioners and reports from other American Lawyer Media publications. Full rankings can be viewed here.

In October 2014, after a two-week trial in U.S. District Court in Wilmington, Del., an eight-person jury unanimously awarded Masimo more than $466 million in damages against the two Philips defendants for infringing two Masimo patents covering technology used in pulse oximeters - a technology that allows clinicians to noninvasively measure a patient’s blood oxygen in the most challenging conditions. The jury also rejected Philips’ challenge to the validity of these patents and Philips’ claim that Masimo owed $169 million for allegedly infringing a Philips patent.

Masimo, an Irvine, Calif.-based global medical technology company, has relied on Knobbe Martens to enforce its patents in multiple lawsuits since 1999. Joseph Re serves as lead trial counsel for Masimo.

“We’re honored to be recognized for achieving courtroom success, but more importantly, we are honored for the trust Masimo has placed in us. Its cases underscore the value and importance of its innovations to healthcare.” Re said. “This case is a good example of the patent system working as it should.”

Knobbe partners Karen Weil, Jon Gurka, and Brian Horne joined Mr. Re in representing Masimo at trial.
