Knobbe Martens Victory Listed in the National Law Journal’s Top 100 Verdicts of 2013

Knobbe Martens Olson & Bear LLP’s victory on behalf of client KFx Medical Corporation against competitor Arthrex Inc. has been recognized by The National Law Journal as one of the largest verdicts of 2013 in the publication's annual report on "Top Verdicts of the Year." In the patent infringement case, the jury found that all of the asserted claims were valid and infringed. The jury also awarded $29 million in damages, which was later increased by the court to account for additional sales and interest.

In this report, the National Law Journal (NLJ) ranks the top 100 verdicts of the previous year based on the amount of the jury verdict award. NLJ affiliate, VerdictSearch, provides findings based on surveys of the nation's courts, reports from attorneys and reporting by ALM Media LLC publications to compile the list.

In August 2011, Knobbe Martens filed a complaint against Arthrex, alleging claims of induced and contributory infringement on one of KFx’s patents pertaining to their unique knotless double row rotator cuff repair, and later amended the complaint to include two additional related patents. The case was tried to a jury in the United States District Court for the Southern District of California in August and October 2013.
